In a series of recent papers, I have made three arguments about how to define “disease” and evaluate and apply possible definitions. First, I have argued that definitions should not be seen as traditional conceptual analyses, but instead as proposals about how to define and use the term “disease” in the future. Second, I have pointed out and attempted to address a challenge for dysfunction-requiring accounts of disease that I call the “line-drawing” problem: distinguishing between low-normal functioning and dysfunctioning. Finally, (...) I have used a dysfunction-requiring approach to argue that some extremely prevalent conditions, such as high blood pressure, high cholesterol, and ductal carcinoma in situ, are not diseases, but instead are risk factors. Four of the papers in this issue directly engage my previous work. In this commentary, I applaud the advances these authors make, address points of disagreement, and make suggestions about where the discussion should go next. (shrink)

This article discusses judicial recruitment in civil law countries. It introduces the emergence of comparative global studies. The United States was the first country to offer university courses on the judiciary outside of law schools. Significant empirical research has been carried out on the system of judicial recruitment since the latter half of the twentieth century and in recent years much of the work of empirically oriented judicial researchers has focused on reforming traditional ways of recruiting and appointing judges. In (...) countries with authoritarian regimes, empirical judicial studies focus on how judiciaries are developed to enforce the regime's policies. Research has shown variations among career judiciaries and their convergence with common law models of the judicial career. It is foreseen that the next wave of empirical research on judiciaries will show how differences in recruitment systems and judicial education influence judicial decision-making. (shrink)

Peter Spader has written a magisterial study on Max Scheler, one of phenomenology’s earliest and greatest figures, whose theory of ethical personalism has become a major voice in the formulation of phenomenological ethics today. Spader follows Scheler’s use of the classic phenomenological approach, by means of which he presented a fresh view of values, feelings, and the person, and thereby staked out a new approach in ethics. Spader recreates the logic of Scheler’s quest, revealing the basis of his thought (...) and the reasons for his dramatic changes of direction. This remarkable study provides a framework that allows us to understand Scheler’s insights in the context of their dynamic evolution of his thought. It corrects imbalances in the presentation of his ideas and defends Scheler against key misunderstandings and criticisms. In short, Spader’s work continues the process of developing Scheler’s pioneering theory of ethical personalism. (shrink)

Studies of patient decision‐making use many different measures to evaluate the quality of decisions and the decision‐making process, partly to determine whether the ethical goals of informed consent, patient autonomy, and shared decision‐making have been achieved. We describe these measures, grouped under three main approaches, and review their limitations, leading to three conclusions. First, no measure or combination of measures can provide a complete assessment of decision quality. Second, the quality of a decision is best characterized vaguely, for instance as (...) “good,” “satisfactory,” or “poor,” and these categorizations depend on qualitative judgments that go beyond quantitative measures. Third, bioethicists should focus on identifying and addressing poor or problematic decisions, rather than trying to incrementally increase decision quality, quantified by a measure. Decision‐quality measures can be useful in research and in advancing important goals of bioethics, as long as the challenges of defining and measuring decision quality are recognized. (shrink)

In this paper, we move toward offering psychological benchmarks to measure success in building increasingly humanlike robots. By psychological benchmarks we mean categories of interaction that capture conceptually fundamental aspects of human life, specified abstractly enough to resist their identity as a mere psychological instrument, but capable of being translated into testable empirical propositions. Nine possible benchmarks are considered: autonomy, imitation, intrinsic moral value, moral accountability, privacy, reciprocity, conventionality, creativity, and authenticity of relation. Finally, we discuss how getting the right (...) group of benchmarks in human–robot interaction will, in future years, help inform on the foundational question of what constitutes essential features of being human. Can original philosophy be done while simultaneously engaging in the history of philosophy? This study examined preschool children’s reasoning about and behavioral interactions with one of the most advanced robotic pets currently on the retail market, Sony’s robotic dog AIBO. Eighty children, equally divided between two age groups, 34–50 months and 58–74 months, participated in individual sessions with two artifacts: AIBO and a stuffed dog. Evaluation and justification results showed similarities in children’s reasoning across artifacts. In contrast, children engaged more often in apprehensive behavior and attempts at reciprocity with AIBO, and more often (...) mistreated the stuffed dog and endowed it with animation. Discussion focuses on how robotic pets, as representative of an emerging technological genre, may be blurring foundational ontological categories, and impacting children’s social and moral development. ABSTRACT One of the overarching problems of the world today is that too many people see themselves as dominating other groups of people, and dominating nature. That is a root problem. And thus part of a core solution builds from Kohlberg’s commitment to a universal moral orientation, though extended to include not only all people but the more-than-human world: animals, trees, plants, species, ecosystems, and the land itself. In this article, I make a case for this form of ethical extensionism, (...) and then present psychological evidence for it in both children and adults, including studies with inner-city Black youth and their parents. Then I build on Piaget’s, Kohlberg’s, and Turiel’s emphasis that interaction with the physical and social world is a critical mechanism for development. My corollary is this: that to reverse the incredibly fast human-caused destruction of nature—the wellsprings of human existence—we need to deepen and extend people’s interactions with nature, and with its relatively wild forms, even in urban environments. Toward this end, I discuss my current body of research and framework for urban design based on what are referred to as interaction patterns. (shrink)

Together these two pieces provide interesting insights into P'olanyi’s work as a research scientist as weIl as reflections on the nature of scientific discovery.

This paper is a sequel to the joint publication of Scott and Krauss in which the first aspects of a mathematical theory are developed which might be called "First Order Probability Logic". No attempt will be made to present this additional material in a self-contained form. We will use the same notation and terminology as introduced and explained in Scott and Krauss, and we will frequently refer to the theorems stated and proved in the preceding paper. The main objective of (...) this study is to show that the probability of symmetric probability systems may be represented as a "weighted average" of what might be called "product probabilities". There is nothing so difficult to understand as the obvious, because the assumptions underlying it are rarely examined or challenged. Technology has become just such an obvious facet of our existence at the start of the twenty-first century. Our daily lives are shaped and directed by technology; it dominates our work and our leisure, constructs our home and work and our means of traveling between them, in ways so obvious it remains, for the most part, unexamined.Technology has the Janus-like character (...) of being both benefactor and threat. Unfortunately, neither aspect of technology is well understood by most of the participants in our current global culture. Until we understand the nature of technology, however, we will not recognize the assumptions and choices inherent in the technology that, at the moment, holds as much peril as promise for our future. Without that critical understanding, we will accept as inescapable what is in fact open to choice. We may make poor choices without recognizing that we are even choosing, and we may miss the opportunities to choose wisely for ourselves and for future generations.To better understand technology, therefore, we need to unpack the obvious and examine technology more closely, both to identify some prevalent assumptions about it, and to provide the conceptual tools we need to make wise choices about the technology we develop and use.These twelve statements about the nature of technology are a starting point for such an examination, a framework for conversation among the choosers and users of technology. The notion of time emerged from the observation of celestial phenomena and the construction of calendars. Its development towards ever higher precision went along with qualitative changes, and was shaped by cultural predisposition. With Einstein's theories of relativity at the lastest, special and general, the nature of time was defined in terms of the metric of a four-dimensional space-time which in turn depends on the distribution of matter. However, it should not be ignored that these theories are local in character (...) and that any projection onto the universe as a whole contains unchecked assumptions. This leaves room for a variety of models. This article promotes the picture of a directed time in a matter-filled space with tree structure, branches developing in the neighborhood of dense mass distributions and possibly ending in black holes. German Der Zeitbegriff der Physik hat sich aus Anfängen in der Himmelsbeobachtung und der Konstruktion von Kalendern nicht nur zu immer höherer Präzision entwickelt, sondern er hat mannigfache qualitative Veränderungen erfahren. Dabei hat es immer auch kulturell bedingte Alternativen gegeben. Spätestens mit Einsteins beiden Relativitätstheorien, der speziellen und der allgemeinen, wurde die Natur der Zeit durch die Metrik der vierdimensionalen Raumzeit definiert, die ihrerseits aufs Engste mit der Materieverteilung zusammenhängt. Es sollte aber nicht vergessen werden, dass diese Theorien einen lokalen Charakter haben und jede Projektion auf den Kosmos als Ganzes ungeprüfte Annahmen enthält. Although a succession of fashions swept the American philosophical scene, C. J. Ducasse was throughout his long career an effective practitioner of analytic philosophy in the classic tradition. As he explained in 1924 "[i]t is only with truths about such questions as the meaning of the term 'true', or 'real', or 'good', and the like . . . that philosophy is concerned. " Such truths are to be discovered inductively by comparing and analyzing concrete cases of the admittedly proper u/le (...) . . . The pressing problems of philosophy are thus in my view primarily problems of def'mition, and moreover, problems of framing def'mitions which must be in formal terms, under penalty of not being otherwise understandable by or acceptable to one or another philosophical school, since the formal elements of thought and tp. ey only are common to all schools. These def'mitions, of course are not to be arbitrary; their relation to the facts of admittedly meaningful linguistic usage is the same as exists between any scientific hypothesis and the facts which it attempts to 1 construe. International Perspectives on Pragmatism combines, in a very appealing manner, a pragmatist approach of democracy with practical politics and history of ideas. The result is a meditation on contemporary society, while in the background there is a continuous debate on the concept of democracy, as defining mark of Western culture. Both its critics and its supporters talk about a decay of democracy, which would not justify an idealist perspective anymore. Arguments for this transpire from both the practical politics section of (...) the volume, as well as from the second part that focuses more on the theoretical side of the discussion on democracy. On a more practical direction, there are contributors maintaining the idea that democracy is corrupt (and examples from today’s world are offered), while the theoretical perspective brings up the Rortian view, manifested through the well-known debate between the foundationalist and the anti-foundationalist perspectives. Democracy in the 21st century is exhibiting some radical discontinuities in terms of its forms and institutions and needs to be rethought, if we wish to have a sustainable future. Democracy increasingly will be shaped by three realities: the demise of the nation state; the failure of representational liberal democracy; and the radical impacts of resource insufficiency and climate change. Yet if no government, however tyrannical, survives for long except by consent of the people, then that consent can serve as (...) the starting point for rethinking what is meant by “democracy.” Three terms are offered as functional categories that allow for an assessment of democratic forms and institutions: subsistence, operational and systemic.
